Abstract

And after: The research aims to present new methods in dealing with contemporary issues and emerging calamities to reach jurisprudence appropriate to the times and human conditions in this era and not to stagnate old statements issued within their circumstances and addressed human problems in the circle of space and time and the conditions that surrounded it and achieved the interests of contemporary humans for it by achieving Benefits they desperately needed or averted evil.

But with the change of circumstances, conditions, time, and place and their multiplicity in relation to human beings, these sayings or juristic views have become incompatible with the current human being.

The research is an attempt to draw some approach that guarantees a balance between novelties and legal constants or is a balance between the variable and the constant in the provisions of religion to coherence the jurisprudence provisions and are suitable for application in this era and to prove to the world the validity of Islam and its provisions for every time and place until God inherits the earth and those on it.
