Abstract

Divorce constituted one of the most prominent legal and social phenomena in ancient Iraq, with legal texts and judicial practices playing a fundamental role in regulating this phenomenon.

Divorce contract formulas in the Neo-Babylonian period were characterized by their traditional character, whose roots extend back to earlier eras. Meanwhile, the Neo-Assyrian period witnessed a remarkable development in the way these contracts were drafted, particularly with the growing interest in legal documentation and the penalties for breach of contract. This study aims to analyze divorce contract formulas in these two eras, based on cuneiform texts, while highlighting the similarities and differences between them in terms of legal style, procedures, and the rights and obligations of both parties.
